Will of Andrew Parke

 

In the Name of God, Amen. I Andrew Parke of the town of Sligo being of sound mind and memory but finding myself in a weak state of health do think it necessary to make and publish this my last will and testament revoking all former wills at any time made by me but first I will and order that all my just debts shall be paid out of my personal properties also my funeral expenses. I will and bequeath unto my dear wife Eliza Parke the whole of the ?outputs? and profits of my farm of ?Toberyautty? in the Barony of Carbury also the ----- ------ and profits of my farm at Carrow------ in the Barony of Tyreragh held in lease by (R)obert (W)illas both in the County of Sligo the ------ and profits arising out the said lands to continue to her my said wife during her natural life as jointure. I will and order that my house in Sligo with all the furniture in it at the time of my death shall continue to my dear wife during her natural life or as long as she chooses to live in it on condition however that she shall lodge in it and support such of my children as are not married as shall wish to live with her those said children making such reasonable allowance for their living as their circumstances will afford and which shall be judges of by my executors hereafter named. I will and order that after the decease of my dear wife the said farms of ?Toberyautty? and Carrow------ also my said dwelling house with their appurtainments shall (pass?) to my eldest son Roger Parke or his heirs male lawfully begotten. I will and order that all my properties of every kind freehold or personal which may remain after my death and said land excepting those properties abovenamed bequeathed to my wife and son shall be disposed of to the best advantage by my executors hereinafter mentioned for the use apportioned by them to be equally and justly directed to the use and the benefit of all my children as hereafter mentioned, that is to say, my sons Roger, Charles, Bliss, Robert and George and my daughters Isabella, Eliza, Ann and Sarah share and share alike. I will and order notwithstanding that should any of my sons and daughters die before they may have married then their proportion of my said estates (excepting always those proportions as bequeathed to my wife and son Roger) that in that case such proportion of any of my children so dying and have not married their proportions shall in that case be equally divided amongst the survivors of my said children. Lastly and constitute as hereinafter and appoint my dear wife Eliza Parke my brother Roger Parke of Dunally, Esqr. And Robert King Duke of Newpark my Executors to this my last will and testament. Andrew Parke signed, sealed and delivered in presence of us this 26th day of May 1803

There follows a poorly-decipherable codicil where he appears (the next day) to be clarifying something about the legacies to eldest daughter Isabella and eldest son Roger. Also that if a child is born to his wife after his demise, that child will share equally with the other children. 27th day of May 1803.

Proved at London with a codicil of 9th July 1810 before the judge by the oath of Eliza Parke widow the Relict and of the executive power reserved to Roger Parke the brother and Robert King Duke the executors. Proved at London this 5th March 1811 1810 before the judge by the oath of Eliza Parke widow the Relict and of the executive power reserved to Roger Parke the brother and Robert King Duke the executors.

 

 

This probate granted in the month of July last to the said Eliza Parke under 20 having been first voluntarily brought in a
